5.8  How long do we keep your PI?

How long we keep information we collect about you depends on the type of information and how we collect and store it. After a reasonable period of time, we will either delete or anonymize your information or, if this is not possible, then we will securely store your information and isolate it from any further use until deletion is possible. We will delete your PI at an earlier date if you so request, as described in section 5.9 below. 

We retain your PI when we have an ongoing legitimate business need to do so (for example, as needed to comply with our legal obligations, resolve disputes and enforce our legal agreements).

5.9  How can you review, correct and remove your PI?

  1. You can request access, correction, updates or deletion of your PI;
  2. You can object to our processing of your PI or ask us to restrict processing of your PI;
  3. If we have collected and processed your PI with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your PI conducted in reliance on lawful processing grounds other than consent;
  4. You may also unsubscribe from any of our communications by clicking on the “unsubscribe” link located at the bottom of our e-mails, updating your communication preferences, or by contacting us here. Users cannot opt out of receiving transactional emails related to their account with us or the subscription service; and

6.1  What is non-personal information?

Non-Personal, Information (“Non-PI”) refers to information that does not identify, relate to, describe, or associate with a specific individual by itself or in combination with other information. It does not include publicly available PI.

6.2  What type of Non-PI do we collect?

Non-PI that we may collect includes:

  1. Log Files: When you visit our website or when you use the subscription service, we may automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses.

However, once the Materials are submitted to us, we will use it for any purpose whatsoever without compensation to you.

10.2  Payment Processing

Your PI may be collected when you submit payment for any orders on our site in which case, you will be able to select a payment gateway available on our site. Each payment gateway provider operates independently of Yes2Yolo and has their own privacy and security policies.

10.3  Email Marketing Communications 

You may sign-up or subscribe to receive email marketing communications such as by providing us with your name and email address. By subscribing and opting in, you agree to receiving updates, messages, newsletters, promotional materials and any other content related to this website. You may unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email. Alternatively, you may opt-out of receiving email marketing communications by contacting us. Please note that you may continue to receive transactional or account-related communications from us.

If you choose to provide us with PI, please understand that your PI may be transferred to any of our affiliates, service providers, business partners or to other third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world.

We put in place appropriate operational, procedural and technical measures in order to ensure the protection of your PI as outlined under section 5.6 above. You acknowledge and understand that by providing your PI:

10.8  European Economic Area & United Kingdom Residents (GDPR Regulation)

1. Legal Basis for processing PI for European Economic Area (“EEA”) and United Kingston (“UK”) Residents

We do not anticipate offering or providing goods or services to individuals living in the EEA or UK as outlined in the General Data Protection Regulation (“GDPR”). However, if you are located in the EEA or UK and choose to access, visit or use our website; or opt to conduct business or collaborations with us; or choose to subscribe to or receive any of our information or free products or services, then we may collect PI from you. In this case, Yes2Yolo is the data controller of your PI for the purposes of the GDPR; except where you provide your PI directly to a third party which you access from our site.

Our legal basis for collecting and using your PI will depend on the PI concerned and the specific context in which we collect it. However, we will normally collect PI from you only where:

ii. we need your PI to perform a contract with you;

If we ask you to provide PI to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your PI is mandatory or not (as well as of the possible consequences if you do not provide your PI). Similarly, if we collect and use your PI in reliance on our or your legitimate interests (or those of any third party), we will make clear to you at the relevant time what those legitimate interests are.

2. Our GDPR Data Retention Period

PI that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. Therefore, after a reasonable period of time, we will either delete or anonymize your information or, if this is not possible, then we will securely store your information and isolate it from any further use until deletion is possible. If certain reasonable events or circumstances call for deletion of your PI, we will do so (for example if Yes2Yolo is no longer in operation, shuts down its site or ceases to offer its products or services).

We will delete your PI at an earlier date if you so request, as described in the above section 5.9 How can you review, correct and remove your PI?

We retain your PI when we have an ongoing legitimate business need to do so (for example, as needed to comply with our legal obligations, resolve disputes and enforce our legal agreements).

We may also collect your information if you contact us for support or service. Support and service calls are recorded and kept on file by the call service vendor. i. Right to information and access:

You have the right to confirmation as to whether or not we process your PI and, where we do, access to the PI, together with certain additional information such as details of the purposes of the processing.

ii. Right to rectification and Right to Object:

You have the right to have any inaccuracies to your PI corrected and the right to object to how your information is profiled. When you contact us, please provide us details on inaccuracies or profiling you object to.

iii. Right to erasure:

In some circumstances you have the right to the erasure of your PI without undue delay. Those circumstances include: the PI is no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; the processing is for direct marketing purposes; and the PI has been unlawfully processed.

However, there are certain general exclusions of the right to erasure. Those general exclusions include where processing is necessary for exercising the right of freedom of expression and information; for compliance with a legal obligation; or where we turn your PI into anonymous data so that you cannot be identified from it for the purposes of statistical analysis, traffic/website usage analysis and other administrative purposes. If we do so, we will not delete your anonymized information.

iv. Right to restrict processing:

You have the right to restrict how we process your information. When we ask for your consent, we provide you with options on how we may process your information. Additionally, when contacting us, please provide details on how you would like us to restrict our processing of your information.

v. Right to data portability:

You have the right to have us transfer your information to another data processor. When contacting us, please provide details on who we are to transfer to and their contact information.

viii. Right to withdraw consent at any time:

To the extent that the legal basis for our processing of your PI is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

If you decide to exercise your rights (such as your right to erasure or right to withdraw consent), please note we will no longer be able to provide you with requested information, products or services.
